Pay-When-Paid vs. Pay-If-Paid: When (or If) Will You Get Paid?


Ohio construction contracts frequently include clauses which condition payment to a lower-tier upon the general contractor’s receipt of payment from the owner. Two very distinct contingent payment clauses exist: the “pay-when-paid” and the “pay-if-paid” clause. Each has vastly different payment consequences:
